A man who worked at Glencore’s Newlands coal mine has lodged a lawsuit after an accident involving a truck.
Yesterday, the Supreme Court of Rockhampton heard that Wayne Keith Brown sustained fractures to his vertebrae after the mine vehicle he was a passenger in hit a pot hole in September 2011.
Barrister Graeme Crow QC said Brown’s seatbelt was faulty, causing him to be thrown around the cabin, The Morning Bulletin reported.
Crow said the lawsuit would be leveled against the driver of the vehicle and Newlands mine.
While the cut-off date for Brown to launch a lawsuit is this Sunday, Justice Duncan McMeekin granted him time to complete the required pre-proceeding provisions.
